Terms and Conditions for Bird Information Limited (Twitter & On-line Services)

Persons subscribing ("Subscribers") to any of the services ("The Service") offered by Bird Information Limited, whether on payment or otherwise, are deemed to accept the following terms and conditions:

  1. While we endeavour to maintain a reliable service, the Service may be suspended for short periods for reasons outside of our control (e.g. technical or network failure). Bird Information Limited will not be liable for compensation in such an event. Should the period exceed five days, Bird Information Limited may, at the sole discretion of the company, offer a subscription extension as compensation.
  2. Bird sightings are reported in good faith. Bird Information Limited cannot be held responsible for any consequences of travelling to see a reported sighting.
  3. Although we undertake to broadcast information as quickly as possible, Bird Information Limited will not be held responsible for any delays in the sending or receipt of information.
  4. Bird Information Limited will not be held responsible for any charges incurred for the delivery of any information from the Service.
  5. Bird Information Limited may terminate the Service permanently without cause or notice at any time. In this event, Subscribers will receive a pro-rata refund based on the length of time remaining on their subscription and the original price paid for the subscription.
  6. Bird Information Limited cannot be held responsible for the unavailability of the Service or any consequential loss due to technical problems beyond our control, however caused.
  7. The Service is tested on a variety of technical platforms, but cannot be guaranteed to work on all combinations of hardware, browser and Internet connection (and, in the case of the Twitter service, phone handset, tariff and phone operator).
  8. Subscribers may not copy or publish in any form, or forward to any third party in any form, any information obtained from the Service, without written permission from Bird Information Limited. Failure to comply may result in the termination of the subscription without compensation.
  9. Bird Information Limited cannot be held responsible for the accuracy or content of any external submissions to the Service.
  10. Malicious submission of inaccurate or offensive material to the Service may result in the termination of your subscription without compensation.
  11. Bird Information Limited reserves the right to publish or not to publish submitted material without notice or explanation.
  12. The inclusion or mention of a bird watching site does not imply that there is a public right to visit that site, or that visitors are welcome. Please check before visiting.
  13. Subscribers undertake to abide by the Birdwatchers Code of Conduct http://www.rspb.org.uk/advice/watchingbirds/code/ when acting upon the information provided by the Service.
  14. Bird Information Limited reserve the right to modify the Service without notification, though any significant changes will be announced via our home page.
  15. We do not provide a refund for Bird Information ltd products and services but product trails are available.

 Terms and Conditions for BirdNet Information Limited (Pager Services)

  1. Definitions - In this agreement the following terms shall have the following meanings:
    1. “Agreement” means the contract made between BirdNet Information Ltd and the customer to which these conditions apply.
    2. “Customer” is the person for whom BirdNet Information Ltd provides the service under the terms of this agreement.
    3. “Service” means the information service provided via mobile phone data connection provided by BirdNet Information Ltd.
    4. “Initial sum payable” means the amount payable upon signature of this agreement before the start of the Information service provided by BirdNet Information Ltd.
    5. “Minimum Period” means the period indicated as such on the agreement, to run from the start date.
    6. “Service Charges” means the charges for the Information service.
    7. “Start Date” means the date on which BirdNet Information Ltd starts to provide the customer with the information service.
  2. Duration
    1. This agreement may be terminated by BirdNet Information Ltd or the customer giving three months written notice to the other party on or after the minimum contract period.
    2. BirdNet Information Ltd reserves the right to charge the customer an amount if the agreement is cancelled before the minimum period. BirdNet Information Ltd shall have sole discretion on this matter.
  3. Charges and Payments
    1. The initial sum payable shall be payable on the signing of the agreement of the customer.
    2. Subsequent service charges shall be payable in advance by the customer on a monthly, quarterly or annual,  intervals by standing order, Credit Card or cheque from the service start date
  4. Termination and Suspension
    1. Without prejudice to its other rights, BirdNet Information Ltd has the right to immediately suspend the service and/or terminate this agreement by notice in writing to the customer and claim for any resulting losses or expenses.
    2. BirdNet Information Ltd shall have the right upon non-payment of news service charge to turn off or suspend the service.  If there is a reconnection following a suspension of the service for any reason, the customer shall be liable for the £20 reconnection fee.
    3. BirdNet Information Ltd may terminate the Service permanently without cause or notice at any time. In this event, Subscribers will receive a pro-rata refund based on the length of time remaining on their subscription and the original price paid for the subscription.
  5. Limitation of Liability
    1. BirdNet Information Ltd shall not be liable to the customer or any third party in contract tort or otherwise including any liability for negligence:
      1. For any loss of revenue, business, anticipated savings or profits or any loss of use or value of any equipment including software; or
      2. For any indirect or consequential loss howsoever arising.
    2. The provisions of this condition 5 shall continue to apply despite any termination or expiry of the agreement for any reason whatsoever.
  6. Scope Phone service
    1. BirdNet Information Ltd shall provide and the customer shall use the service subject to the following terms described:
    2. BirdNet Information Ltd will use its reasonable endeavours to maintain the service. However it is agreed and acknowledged between BirdNet Information Ltd and the customer that:
      1. The service may be impaired by physical or topographical features and by atmospheric conditions or other causes of interference man-made or natural.
    3. BirdNet Information Ltd does not guarantee the accuracy of the information on the service.
    4. BirdNet Information Ltd may suspend the service if it is obliged to comply with an order, instruction or request of the government or other competent administrative authority.
  7. Entire Agreement
    1. This agreement represents the entire understanding between the parties relating to the subject matter herein and supersedes any other agreements made by either party whether oral or written and this agreement may only be modified if such modification is in writing by a duly authorised representative of each party.
  8. Service of Notice
    1. Any notice invoice or other document which may be given by BirdNet Information Ltd under this agreement to the customer shall be deemed to have been duly given if left at or sent by post, telex, E-mail or fax to the customer’s address as given on the initial agreement.  Any change of same must be given in writing, E-mail or by telephone to Bird Information Ltd.

  9. Refunds
    1. BirdNet Information ltd will only provide a refund, for the remaining of the contract, based on pager signal loss from both PageOne and Vodapage.

Consumer Credit Act

The terms and conditions set out herein are subject to the rights expressly granted to an individual under the Consumer Credit Act of 1974, including the right to terminate this agreement.

Governing Law

This agreement shall be governed by, and construed and interpreted according to English Law and in the jurisdiction of English Courts.

Alteration of Terms and Conditions

BirdNet Information Ltd has the sole right to change the terms and conditions in the agreement but only with 1 month’s prior written notice to the consent of the customer.
